If a parent has a legal duty to protect his/her child, and the parent violates that duty by failing to act, can the parent have criminal intent?
Anything that is bound by the law is ultimate. If the parents have the duty to protect the child, the parents are bound by the law. A parent might ignore to take care of the child for several reasons. Most of the time, parents don’t do it intentionally. Parents who live together normally take care of their children well. The problem starts with single parents who tend to ignore the child for several reasons such as job, looking for a partner etc.
In my opinion, parents do not normally have criminal intent in failing to take care of the children. Their failure is due to unavoidable circumstances and not because they wanted to ignore and fail to protect the children purposely.
