RCDI Management contracted with Patel to construct a hotel in North Carolina. RCDI was licensed in West Virginia but not North Carolina. RCDI assigned the contract to a subsidiary that was licensed in North Carolina. When construction was almost complete, water damaged the building, and it was recommended that the building be gutted. The contract was terminated. Does the fact that RCDI was not licensed in North Carolina prevent it from claiming contract rights?

Yes , it is true RCDI was not licensed in north caroline prevent it from claiming contract right, AS the agreement is between RCDI and patel and patel is not in the contract with any of the subsidisary. so , the contract between RCDI and patel is not valid contract . According to the law applicant can only get certificate to work in a north carolina if the applicant did not obtain a west virginia license through any agreement between the west virginia contactor lisencing board and any other state. so RCDI is not certified to work in north carolina. so the contact is not valid.
