Section 1 The Charter of Rights and Freedoms specifies that the liberties are protected. It allows the Government to regulate the Charter freedoms of One guy. It only comes into effect when a right has been violated. The responsibility for evidence rests usually with the Government

Section 33 of the Charter of Rights and Freedom requires the governments to circumvent Charter freedoms briefly. This helps the state, municipal and regional governments to override the privileges of the Charter.
