It is important to keep in mind that employees only have a reasonable expectation of privacy. Employers can lower the threshold of what is deemed reasonable by developing a clear policy that addresses privacy issues in the workplace and communicates the policy to their personnel. Several states have passed legislative or constitutional protections protecting the right to privacy of their people from such intrusions. However, in the absence of a state constitutional provision or existing law, private employees enjoy relatively little liberty from intrusion into the workplace. Private employees therefore have to look to standard, or judge-made, law to find safeguards for privacy.

  1. Intrusion into private isolation or a seclusion of an person. An employee may claim this form of privacy invasion when an employer searches unreasonably (e.g., a locker or desk drawer) or supervises areas where an employee has a legitimate expectation of privacy. The employer's unsuitable screening of an employee (e.g., orientation) can also give rise to such a argument.
  2. Private details are publicly disclosed. An employee can assert this type of privacy invasion when an employer discloses to a large audience, without his or her permission, private and, potentially, humiliating information about an employee.
  3. Portraying a human in the wrong light. Under this theory, the employee may claim a violation of privacy if an employer analyses a false or offensive behavior or characteristic to an employee that is not true (e.g., criminal activity).
  4. Using a name or a likeness of an person. Where an employer uses a picture or likeness of an employee or refers specific statements to an employee without his or her permission, an person may have a legal claim for misappropriation (e.g., the employer publishes a picture or likeness of an employee on company brochures without first obtaining consent of the employee).
