What is at the heart of the disagreement in Good News v Milford? Why were there so few Court cases about religion in the days of the founding fathers, but so many in todays century?
When Milford denied the Good News Club access to the school's
limited public forum on the ground that the Club was religious in
nature, it discriminated against the Club because of its religious
viewpoint in violation of the Free Speech Clause of the First
Amendment. This is the heart of the disagreement in Good News v
Milford. In the days of the inception of religions, there were
little or no conflicts between the religions and the working of the
society. But as days passed, restrictions were put on activities
based on the religious beliefs. This led to more and more conflicts
and thus the cases rose. Thus, there were so few Court cases about
religion in the days of the founding fathers, but so many in todays
century.
