Estate Planning is concerned with both Probate and Securities Law in the following manner:
1. Probate Laws: Estate Planning involves distribution of a person's assets to its beneficiaries. Probate Law is directly concerned with the Distribution of Deceased person's property to its legal beneficiaries after settlement of all claims towards the same.
Hence there is direct nexus between the Estate Planning and Probate Law. Therefore study of Probate Law and its provisions affecting the Estate Planning shall be strictly studied.
2. Securities Law: It may happen that Estate of a person may consist of Securities whose distribution may involve provisions of Securities law. Hence tax or charge may be applicable on such distribution as per Securities Law or some disclosure or reporting requirements could be possible. Hence estate planning shall also involve study of Securities Law.
