What are your thoughts about the homosexual advance theory and other perceptions of homosexual men and women as witnesses and jurors? How should a person be perceived in terms of credibility based on their sexual orientation, particularly as it relates to sex-related crimes?

Homosexual advace theory is a legal defense, usually against cahrgea of assual or murder. A defedant using the defense claims that acted in a stat of violent temporary insanity because of unwanted homosexual advances from another individual. The defedant alleges to find the same sex sexual advances so offensive frightening that it brings on a psychotic state characterised by unusual violence.

Sexual orientation is an enduring pattern of romantic or sexual attraction to person's of the opposite sex or gender, the same sex or gender, or both sexses. Scientists do not know the exact causes of sexual orientation, but they beleibethat it is caused by a complex interplay of genetic hormones and environmental influences.

The "Homosexual Advance Theory" is generally involved in cases where the guilt of the detedent is unquestioned, but only to strengthen more traditional criminal law defense such as insanity, diminished capacity, probication or self defense is not meant to orovide justification of the crime on it's own. While using "Homosexual Advance Theory" to explain insanity has typically not been successful in winning a comolcom acquittal, diminished capacity, provocation and self defense have all been used successful to reduce charges and sentences.
