The answer is mixed. For severe crimes which has irreversible loss like rape and murder, death sentence has to be mandatory. As said, these have irreversible loss to the person affected, to its family and their reputation damage in the society they live in and a punishment which matches the decree of the crime has to be given, which is nothing but death, irreversible punishment to the accused as well. This would bring a fear amongst people and reduce crimes which has the potential to totally devastate lives. For other crimes such as robbery, fraud etc punishment can be at the discretion of the judge. These crimes has reversible loss, like, money or things can be returned. Even in case of blame and only reputation loss, fine and verdict on innocence suffice.
Depending on the loss, crime done, the severity of the punishment and the discretion of the judge has to be decided.
