According to the IRAC, you will have to refund the amount to me as I hired you for your services to be an attorney to represent in a bankruptcy case. As an attorney, You cannot delegate your services of an attorney to your friend. You cannot delegate without my concern. You will have to give the refund. Otherwise, I can sue you for it. This rule is applicable for all kind of services if the person providing service is specified in the contract.
Solution:
This rule is applicable when it is clearly stated in the service contract about the nature of service, the details about the specific person being the attorney, the fee structure among others. Hence, if the details of any specific attorney is mentioned in the contract, only that attorney can carry out the proceedings. If any other attorney replaces the ones mentioned in the contract then the party can sue the attorney for breaching the contract terms.
