It is a type of Lien in which the party winning the lawsuit can have access to the property of the losing party and there is no requirement of any agreement or consent because the fact that they are winning is giving them the consent to have the lien. The real property owner needs to be concerned about the same because they need to be careful as the property they purchase in the future can also have the lien applicable to the same so they needs to be quite sensible in maintaining and handling their property or else they may experience various issues regarding the same. Private restrictive covenants in this case needs to be enforced in order to make the lien and the application of the lien quite effective so that the parties do not experience any issues for the same.
