Although participants believed that they had a moral duty to prevent sex partners from becoming infected with HIV when it is came to a law mandating sero stattus disclosure they wanted both sexual partners to be held accountable for HIV.

During the early ages of the HIV epidemic a number of the states implemented HIV specific criminal exposure law.Some of these state law criminalize behavour that cannot transmit HIV and apply regardless of actual transmission. As of 2019 34 states had laws that criminalize HIV exposure.
