The Internet is the new soapbox anyone can use to voice an opinion. With that being the case, can a website that is critical of a business use the trademarked name of the business?

Can those critical of the commercial practices of a business use the business's name and also employ metatags to draw browsers of those who input the business's name in the search engine?

Which value should receive the highest weight—the right of a company to protect its trademark or the right of unfettered free speech in the marketplace?

Answer #1

The Right of the company to protect its trademark should be given high priority because it is not fair to use the trademark name to defame a company provided there is no serious allegations against that company. Also if the allegations are false the company can file a lawsuit against the person who has written such statement.

Having said so if there is any critical allegation against the company and it needs to be put forward so that the rest of the world knows about it.It is fair to do so in a social platform.

As evidence of this, Elliott’s lawyer, Richard M. Wirtz, cited the American Dialect Society’s decision to declare the verb google the...
