1. The appeals court affirmed the sentence and noted that they could have been much heavier. Assuming the same size lost occurred, whhy would the penalty be greater if such a fraud threatened the solvency of a bank?

In this is specification fraud was extremely large which was affecting economy of a whole business. This type of approach would have been taken more strictly and hefty penalties should be implemented on the dependent. As the property was misappropriated, this is a clear form of corruption as well as provision of the services to the depending were unethical and illegal.
Considering above conditions penalty should have been much greater in the specific case as it was affecting solvency of the bank.
