MCA § 25-13-501 provides the following regarding gold dust:
"Gold dust must be returned by the officer as so much money collected, at its current value, without exposing the same to sale."
What does this mean?
MCA stands for Montana Code Annotated. Here the number 25-13-501
is denoting a special information. The no. 25 refers to Civil
Procedure, 13 refers to Execution of Judgment and 5 refer to the
Property Subject to Execution. Therefore in our context Montana
Code Annotated refers to the Law regarding the judgement of
property which are subject to execution during a civil
procedure.
It’s a legal term making change in the wording will change the law
itself. However the phrase “Gold dust must be returned by the
officer as so much money collected, as its current value without
exposing the same to sale” refers to the property which are subject
to execution whether money, goods, shares, debts, etc. which not be
affected by the execution until it is subjected to levy.
Remember unit the property is levy it should not be sold or be a part of execution. In fact it should be return in current value.
