It is absolutely fine to invest in their stock if you are investing your personal money. It will be a crime if you are investing the company money or assets in it in any way. The companies that are getting merged have nothing to do with the company you are working for. Investing in things is my personal choice and I am doing it with the money I have so the company has no right to question me. It is very common that the employees invest in various things like stocks, real estate, and gold. The company cannot control the activities of the employees to such an extent that they ask the employees not to invest in anything. So it is very much legal to invest in the stock of the two companies getting merged.
