Ideas are protected under law when they are deemed as “intellectual property”. Find an example of a lawsuit where intellectual property was allegedly stolen.
1.) Describe the idea or invention in question.
2.) What type of IP was it?
3.) Do you side with the plaintiff or defendant in the case?
4.) Why?
The ideas that were stolen which are protected under law deemed to be known as intellectual property is visible in a case of Pune-based entrepreneur Shrikant Kunden whose ideas of geographical location system were stolen by Zippr company.
The Plaintiff is Shrikant Kunden.
The defendant is against Gagan Aggarwal, Zippr and Indian Angel Network (IAN).
1. The idea was a Digital Location System which was an innovative technology to solve core address infrastructure challenges.
2. The type of IP is Trade Secrets, in which information is protected.
3 & 4. I side by the plaintiff because it was the original ideas by Shrikant Kunden team, so it should not have been disclosed by Gagan Aggarwal who was a former member who passes the trade secrets to Zippr. As the idea was way back in 2012, where the idea was submitted to an innovation challenge hosted by Government of India’s Department of Science and Technology and Confederation of Indian Industry which was sponsored by IAN. The plaintiff won Rs 25,000 for the idea for being in 4th place. Gagan was the first person who initiated a company based on that, but the discussion was not fruitful, so ideas remained as ideas and to Zippr, Gagan gave ideas and they started the company in 2013.
