(TCO I) When you examine a negotiated agreement, you will find a variety of issues that can be put into the category of wages or economic concerns. However, the contract is not limited to these issues. There are a variety of issues that go beyond economic concerns, such as the union obligations. It is not just that management is required to perform a certain way according to the requirements of the contract. It is often felt by management that they are giving up everything in order to live by the contract. From a management point of view, the union has taken control without obligation through the function of the contract. (a) Evaluate the obligations that the union might have under the contract in terms of what they mean to the functioning of the union and management. (b) Lay out a plan to help management implement its options if the union does not meet its obligations.

The main duty of either employers or employee unions is to follow rules , maintain pleasant work atmosphere and doesn't violate law in any manner.

Eg : employers violation

* threatening / pressuring the unions that the plant will be closed / they would loose jobs if they select a union to represent them / put any demands of union before them.

Violation by employees :

* striking over issues that are unrelated to employment terms and conditions.

Also a trade union has duty / obligation / responsibilities as follows

* To observe union rulers and pay the contributions regularly on periodical basis.

* they should inform executive committee if any changes in personal particulars.

* they may also take part in management of union by assuming union office as appropriate.

Duties/ obligations of trade union officers :

* trade union officers are selected by their agents to handle administration of union and comply with Trade union officer rules and union rules in managing the union.

* important decisions / discussions relating to various issued by union will submit their reports to General meeting for the purpose of accepting , discussion and voting by members.

* the conclusions / decisions / discussion results are to be followed by these unions with due respect and acceptance.

b)

After employees chose a union as a representation " fair price bargaining " takes place where by it is to know the reason behind non fulfilment of contract terms and obligations and what is that mutual acceptance point which gives labour a motto to work and levy duties and management in creating smooth work environment.

* bargaining method / fair bargaining practice :

? it is unfair labour practice for either party too refuse collective bargain but either of parties should not be compelled to make agreement / reach mutual acceptance.

* the necessity of good faith bargaining is to find pout a basis / common understanding through which agreement can be made.

* at the decision table ,

? firstly needs and demands of employees via there agents will be put.

? the desirability , reasonability , and necessity of the same will be analysed.

? if accepting the demands whether in short run / long run creates any inconvenience / lack reasonability / threat to the company will be verified.

? if yes , then the same will be explained to union representatives inorder to obtain common understanding.

? if not a threat to management , then terms are agreed with mutual consent.

? in order tho safeguard whole discussion a agreement in writing will be made.
