Briefly describe the legal framework for damages. What must be proved in order for a plaintiff to prevail in seeking damages?​

In general party who suffered must prove that other party is liable for paying damages and demonstrate the loss he suffered due to the actions or lack of actions of other party.

Proving this the party need the following proofs:

1)Proximate cause means the damage happen due to actions of lack of action of other party.

2)Reasonable certainity means the party who suffered loss is eligible for damages.

3) Foreseeability means that risk exists insuch actions or lack of actions are foreseeable and if they are foreseeable then thw offendin party is responsible for taking care to prevent them and they didn't prevent resulting damages payment.
