Making type 1 error is worse.
Let's understand this by example
Ho: verdict is not guilty
H1: Verdict is guilty
Type 1 error: rejecting the null hypothesis when it is true.
So we are rejecting that verdict is not guilty when in fact he is not guilty. This is more serious as innocent person will get punishment.
Type 2 error : accepting H0 when it is false
Here we are saying that accepting that he is not guilty when in fact he is guilty.
Although by making type 2 error criminal not getting punishment but at least a innocent person is not getting punishment.
So making type 1 error is worse
