Title VII does not extend discrimination protection to affinity orientation. What is your opinion about this limitation?
Title VII covers protection against discrimination based on an individual’s sex as it pertains to their gender, but does not extend to affinity orientation, which is another important aspect of gender identity. In my view, Title VII should be extended to offer legal protection against discrimination to individuals who are transsexuals, or have undergone gender reassignment surgery as well as those with bigender affinity orientation. Instead of overt discrimination, employers may engage in acts that result in things like being overlooked for a promotion, being given baseless write-ups or improvement plans, and wrongful termination. Without appropriate legal protection, there is a possibility that employers promote differential treatment simply because they disagree with their employee’s sexual orientation.
