The Fourth Amendment establishes the right of people to be secure in their persons, homes, papers, and effects, against unreasonable searches and seizures.
Given the varying case law regarding search and seizure, do you think that the general public understands their rights in regard to the Fourth Amendment?
Do you think that the criminal population understands this right? Is it important to understand it? Why or why not?
Yes, general public understand a their right regarding the protection against search and seizure without a warrant. They know that property and privacy will be protected and that police cannot arrest them without a legal warrant. They know that they won't be unnecessarily harrassed without a proper cause and warrant.
On the other hand ,the understanding of this amendment to criminal population gives them added advantage to carry out their illegitimate motives,as they know without a strong evidence police could not interfere in their illegal activity and gathering a strong evidence is difficult for them because of this amendment. Thus, this amendment makes police investigation slower and it's effectiveness less.
