Miranda rights is triggered when a person do not want to provide any answer to the police investigation and demands his or her attorney to be present. The person would confide everything to the attorney and ten only in the attorney’s presence would answer the questions raised by the police. If the police have sufficient evidence, the police can proceed with that but if they don’t, they can’t force the suspect to answer the question if the suspect who is arrested demands an attorney. There are also other occasions when the suspect may not need an attorney thus answer questions without the presence of an attorney.
