Answer #1

In the casd of Fred Scott v Stanford the Supreme Court decided that the people of African descent, whether free or enslaved, would not be considered as American citizens. Neither, were these people allowed to sue the court or apply in any sort of judicial systems.

Congress did not been heavy the power that they would be banning slaver in the territories of the United States. Also, the court have declared that the slave ownersrights wuold be protected by the fifth amendment.

I would not give such a ruling, had I been in the Supreme Court. For me, the freedom of a person is much above their religion or ethnicity and should not be considered with the lens of the same. No person could be considered as property, whatever be the case.
