The prosecutor has a special power to charge or not charge to someone. This right is called prosecution discretion. Though the prosecutor has the liberty for his choice by the same time there are some limitations also.
The limitation regarding the prosecution description is that the description cannot be used for selective prosecution. It means a prosecutor cannot be prejudice to determine what to charge. He can not be rationalized by personal motives. A prosecutor may be asked the appropriate question if needed in any particular discretion.
