a) Sonya recently visited Prams R Us to purchase a pram. She explained to Nina, the sales assistant, the pram had to be designed in such a way that there was no chance her baby could climb out of the pram “ as he is very active and always moving ”. Nina recommended the expensive Princess Monica Pram which had an adjustable elastic fastener across its top that could be fitted around a baby. A few days after purchase Sonya’s 16 year old eldest daughter Mary, was trying to adjust the elastic fastener when it suddenly snapped causing serious injury to Mary’s left eye. Sonya has been informed Mary’s injury will require surgery and hospital treatment for a number of years. The pram had been purchased from Prams R Us with the use of a debit card but had not come with any instructions and its original packaging had stated it had been ‘ Made in China especially for Prams R Us ’. Advise Sonya and Mary of any remedies available to them.
b) Jeff has recently travelled to the USA and made a number of purchases with the use of his Risa credit card. One purchase was a state of the art Pear laptop for £699 in UK currency. Since returning to the UK the laptop has failed to function properly and Jeff finds that after only one hour’s use the laptop turns itself off.
a. It is one of the universal truth that most of the products made in China are cheap and the products are not reliable. If there is any defect the company does not take any responsibility. Most of the products are defective and the customers should avoid Chinese products. So, from this experience Sonya should file a case against the Chinese products that do not have any customer liability. She should avoid purchasing Chinese products.
b. Jeff has no tension in such matter. All the products of the United States have customer liability. The companies do not avoid customers. Naturally Jeff can get a new laptop even from UK.
