How does retributivism provide a "deserved and fitting " constraint on the imposition of punishment under a utilitarian theory of deterrence ?
Utilitarianism justice suggests that the people are rational beings and their actions would be considered ethical, just, moral and legal if they bring general happiness. It also suggests that the punishment is a mean to deter criminals from engaging in further crimes. This would mean that as per retributive justice, criminals should be punished fitting to their crimes which would not only bring happiness to the victims but also to the general public because they would be happy about the justice served.
