Racial disparity in the criminal justice system has been acknowledged various practitioners and policy makers who recognised the need to make a change in the system thereafter. Racial injustice in the criminal system occurs when the proportion of a racial group within the control of a system is greater than the proportion of such groups in general population. The causes of such disparity may be varied and they may show their impact in the form of influencing the law enforcement, policy making, etc. for reducing this racial disparity, many practices came into play. This included probation and community supervision as one aspect of countering the challenge. Some questions that need to be looked at are “Have probation officials reviewed the factors and processes that influence their sentencing recommendations, and satisfied themselves that they do not inadvertently impact negatively on racial minorities?” or “Have probation officials developed a range of graduated sanctions to use in response to noncompliant behaviour by probationers?” Parole decisions and jail and prison custody are certain other aspects that can be kept in mind in order to bring about changes in this system.
