2. James Jones worked at Burger King in Orlando, Florida. James discovered that Burger King was not properly storing its meat. Several customers became ill after eating this same meat. James called the Board of Health regarding the meat. James was terminated for no reason the next week. James sues for wrongful termination. Using the IRAC format determine whether James would win.
Issue- Termination of James without any notice
Rule- No employee can be terminated with out giving proper notice and reason for termination
Application- James acted as a whistleblower and being a responsible employee with highest moral attribute called Board of Health reagrding the reason for the incident. After all these incident Burger King terminated James.Whistleblower are protected in USA and Florida also. An employee cannot be terminated for acting as a whistleblower in any circumstance.
Conclusion- James will win the case because none of the rule he has violated for whom he would have terminated.
