One cannot bring legal actions to the government on the basis of
disliking government's action of law. Federal court has the
authority to only resolve actual disputes.
There are three conditions based on which can determine their
standing to appear in critical court:
- Redressability: It must be likely, as opposed to simply
speculative that a favorable decision by court would redress
injury
- Causation: There should be a causal connection between conduct
and injury that is brought before the court. Injury caused by
defendant should be traceable and not due to some independent
action of third party which is not present before the court
- ‘Injury in fact’ suffered by plaintiff means that plaintiff
have suffered injury or will suffer injury - an invasion of legally
protected interest which is a) particularized and concrete b)
imminent or actual. The type of injury can be: non-economic or
economic or both.
