Ronny advertised his car for sale for $ 50,000 in the Star newspaper. Kali saw the advertisement and went to Ronny’s house with a cheque for $ 50,000. Ronny refused to accept the cheque and Kali stated that she would sue Ronny for breach of contract. The next day Jess inspected the van and later wrote to Ronny enclosing a cheque for $ 50,000 and saying he should assume the van was his unless he heard to the contrary. Ronny did not respond to Jess’s letter. Gurmit also inspected the van and was told by Ronny that he would not sell for three days to another purchaser. One day later Harry arrived with $ 48,000 in cash, Ronny accepted the money and allowed Harry to drive the van away. On the same day, the moment Gurmit received a message from Ronny stating that he has already sold the car to some else, Gurmit went to Ronny’s house informing him that he is accepting Ronny’s offer for the car. In my opinion, since Ronny has already sold his car to Harry for $ 48,000 in cash, hence he cannot do anything even if he is getting $ 50,000 from Gurmit for the car. Since the car is now legally owned by Harry as contract hadalready been negotiated between Harry and Ronny, hence Ronny has no say with regards to decision about reselling the car as it is not his property now. If Gurmit wants to own the car, he must negotiate with Harry as he is the real owner of the car now.
