Answer #1

Appellate Courts are the courts, which are responsible for hearing appeals of cases, which have been already trialed in the lower courts.

Appellate procedures are the practices followed by the appellate courts to review the appeals. These procedures include hearing the appeals, correcting judgment error of the lower courts, developing law and communicating the same to lower courts so as to make it standardization.

Appellate procedures consider the following before hearing the appeals:

  • Which type of judgments are worthy of an appeal
  • The procedures which the involved parties must follow
  • Procedure to be followed for reversal of court judgment

Appellate courts also hear oral arguments and written arguments, which are the written brief about the case, prepared by the involved parties.

The courts of appellate courts are considered critical as the decisions of appellate court come second to that of Supreme Court in the judiciary. The decisions are considered as binding precedent as they become binding on the parties and must be followed.
