In the state of Florida, wardriving is not legal and a felony of the third degree in the state of Florida. A third-degree offense in Florida takes up to 5 years, with a fine of up to $5000. Wardriving is not a gray area in the state of Florida. All conditions considered wardriving are laid down very clearly in the Law. I think this is so much a personal property issue as an ethical issue. I agree it ought to be illegal to wardrive. While everyone may or may not have the technical expertise to secure their wireless internet properly, people do not have the right to use it. In case your house is not properly locked, the uninvited guest is not entitled to enter. The guest is not invited and should be regarded as a criminal in both cases.
