1. Aron bought a handkerchief from Textiles (T) Ltd. at Tshs. 30,000/= and clearly informed the seller that, the handkerchief will be used by his daughter called Mrembo. When he reached home, Aron gave the handkerchief to his 30 years daughter (Mrembo) to use it. Mrembo was a second year student at the University of Dar es Salaam Business School pursuing his Masters of Business Administration Degree. After Mrembo had used it for about three days, her nose was "burnt" and she rushed to the doctor. The latter certified that the "burning" was a result of using the handkerchief. Mrembo wants to sue Textiles (T) Ltd. Advise her on her chances of success, if any.

Since it has been certified by the doctor that the "burning" of Mrembo's nose was a result of using the handkerchief which was bought from Textiles (T) Ltd by her father Aron, hence Mrembo has a strong chance of winning the case against Textiles (T) Ltd. since the company gave a defective handkerchief to Aron which caused injury to his daughter's nose. All the damages occuring out of her treatment and expenses incurred in purchasing the handkerchief, doctor consultation ecpenses, legal fee etc have to be borne by Textiles (T) Ltd.
