  • Items whose terms and conditions must be negotiated between management and workers are called mandatory subjects of bargaining
  • These items are not mandatory subjects of bargaining. Either party can propose to discuss permissive subjects of bargaining, and the other side may voluntarily bargain on those subjects
  • Employer cannot vary the mandatory items unless it communicates the same to workers
  • In case of permissible bargaining items, there is no obligation on communication
  • permissible bargaining items include terms and conditions of employment
  • mandatory items include contract length, union security clauses, wages, benefits etc.
