In complete sentences, provide an answer to each of the following discussion questions:

1) Winona contracted with Comcast, a broadcast media firm, to cohost an internet-streaming sports program. Winona and ComCast signed a new contract for each episode. In each contract, Winona agreed to work a certain number of days for a certain salary. During each broadcast, Winona was free to improvise her performance. She had not other obligation to work for ComCast... Was Winona an independent contractor?

2) There were two certified mechanics, one being the supervisor, who were employed by an aircaft repair business located at the small local airport. While working on a plane, the mechanic took a personal cell phone call. The distraction of the call caused the mechanic to fail to complete a task properly. Because the supervisor was "busy", he signed off on the repairs without checking the mechanic's work. The next day, the pilot takes off. The engine quickly malfunctions causing it to crash critically injuring the pilot. After investigating the crash, the NTSB (National Transportation Safety Board) issued a report stating that the improperly completed task (caused by the cell phone distraction) was the cause of the accident. Briefly describe who can be held responsible for the pilot's injuries and the damage to the plane.

Thanks!

Answer #1

1. No, Comcast did very less to control the work of and how she worked. Also, they created a new contract for each episode and Winona was free to improvise her performance but in an independent contract, this does not happen.
2. As per the given situation, the supervisor should be held responsible for the injury to the pilot and damages.
The incident happened due to the negligence of the mechanic who took a personal cell phone call but the supervisor is responsible to monitor the work done by mechanics. He signed off on the repairs without checking the mechanic's work which is why it's ignorance must not be tolerated and he must be held responsible for the pilot's injuries and the damage to the plane.
