Discuss the components of the Agreement to Participate. Why would you want to use such a document even when you cannot (or choose not to) use an exculpatory agreement?

If we talk about agreement to participate then it is not a contract. It is considered a signed agreement which says that the participants in the survey will going to be adhered to the rules and regulations and understand about all the risks involved in the participation. The components are like

  • Details of the party which is organizing the event.
  • The second component is acknowledgement of code of conduct and standard rules. The details should be there and not shortcut.
  • All the dangers have to be mentioned clearly and there should be explanation as well.
  • The participants have to signature and their details have to be mentioned the place where the event is happening and what date it is happening it has to be mentioned.
  • There should be consent about publicity release.

This is not an exculpatory agreement that is why if any damage happening in the event then it will be completely free from the liabilities. The central idea about the agreement to participate is to be free from the liabilities if the participants take advantage of firm. That is why agreement to participate is a useful document.
