This is not fair, because people may not be able to either read it or may not have the time and focus to read it.
I don't think any further change to the enforceability of click wraps is required. The law has already taken steps for the same. Law says that a contract of that sort is binding only when:
1. The terms are in a place that can be seen or found easily and has an option to not agree to the contract.
2. It can be printed or saved and reviewed later.
3. It should be in a format visible to a normal person.
4. Contracts which says that "if you continue reading this page, you agree to this contract" are not legally binding.
