There can be a great deal of subjectivity in the term "qualified." How could qualifications be adjusted to get the type of people sought? Is this a weakness in the law?
Qualified term is highly subjective. It is difficult to measure qualified in objective terminology. Only qualifications should not be a measure of a person. It should be a combination of skills, technology, attitude, knowledge which are achieved by the people. Qualified applicants can be adjusted to get people with appropriate skills, expertise, a competent person who is well-versed in the required skill. In England, the qualified term is used check for a person who is prepared to take responsibilities and oath for a new appointment. It is not a weakness in law rather the internal meaning needs to be understood.
