Creative Advertising Ltd. employed Igor as a copy design editor for many years. The work was very stressful, but Igor enjoyed the work, as it required a great deal of originality and creativity on his part. In particular, he enjoyed the ‘presentation to clients’ aspect of his job, as it gave him the opportunity to explain his work to clients, and the results he expected from it in terms of product sales. Unfortunately for Igor, at age 49 he suffered a stroke which left him with a serious speech defect, but otherwise unaffected. The stroke made verbal communication with clients impossible, but he was still able to carry on with his creative work. His employer, however, decided that Igor’s services were no longer necessary, and gave Igor notice of termination along with a cheque equivalent to 6 months salary. Answer a= The given case is a typical example of employees with disabilities. As per the law Americans with disability act, it is the responsibility of the employer to accommodate the disabled employees provided that their disability does not result in any major restriction in fulfilling the core duty of the job. As in the given case, Igor was not able to speak properly and thus not able to present the presentation in front of the customers, but he can provide his creativity to serve the organization as before, thus there is a proper implementation of the law American with Disability and the employer can easily accommodate him on the job. Thus I would suggest Igor file a case against the employer on account of breaching the provisions of Americans with disabilities.
Answer b- The employer can simply provide the jobs of creating the creative presentation to Igor while the presentation of these creative works to the clients can be made by other individuals.
Answer c= The job responsibility of Igor has two aspects, first to develop the creative and innovative piece of work and then to present it to the clients. If we look at the given case, Igor is hampered to speak properly but he can perform the other tasks that are to create the creative presentation and thus it is clear that there is a partial disability with Igor to perform his duties
Answer d= the presentation to the client is of secondary importance. The main job responsibility of Igor was to produce unique and innovative presentations that can be presented to the client by any individual.
