In United States, the charges of battery is correct when a person intentionally hits another with a physical contact. He was drunk. He didn't hit the person whom he wants to hit. It was mistakenly done act.

He has to feel guilty when he hited a person mistakely. there were many peoples around him in a bar. He didn't hit any other. He did this act mistakenly. So he has to be guilty for the act.

The Mauricio has to be guilty for this crime. His intention was to hit the person. Whatever the reason for his intention but voilence is not the way to deal with the situation. So, has to be sorry for his act and get charged battery.
