Parker & Parker is an extremely busy sports agency, representing major league athletes. Parker & Parker has 123 employees. In order to keep up with their workload, they refuse to hire anyone as an agent who is unable to travel 25 weeks of the year to represent clients all over the country. They also require that all agents be male because they believe men are more knowledgeable about sports, and most of their clients are male and usually prefer male agents. Please analyze the legality of each of Parker & Parker’s separate requirements (ability to travel 25 weeks and be a male). Explain and provide thorough legal analysis.

Gender Discrimination

Labor laws are different across the world and I am assuming that you are from US. Hence I will be using the US legal system to explain the concept.

There is a council called US Equal Employment Opportunity Commission (EEOC) which governs these issues. Under the laws enforced under EEOC, it is illegal to discriminate against someone based on various factors such as race, color, religion, national origin, age or disability and also gender. This law forbids discrimination of any form when it comes to hiring new employees.

Also, employment discrimination law is mentioned in the Civil Rights Act of 1964. Also the constitution, through its 5th and 14th amendments limit the power of the federal and state governments to discriminate.

Ability to travel 25 weeks

There are no laws in the US that can restrict an employer to enforce excessive business travels to its employees. However, in case an employee has a case, then a litigation is certainly possible. In such a case, the employee will have to establish a certain link to the problem she is facing that is in consequence of the excessive business travels.
