The authority for creating of national parks can be found in the U.S. constitution. It is present under the “Property Clause” under section 3 of article IV.

The necessary elements and conditions that should be met for the creation of national parks are:

1. The park should have a minimum size of 1,000 hectares. Within the park there should be zones in which protection of nature takes place.

2. The park should have a budget and a staff size that is sufficient to ensure effective protection.

3. The park should prohibit exploitation of natural resources through activities like fishing, hunting etc

4. Visitors should be allowed to enter the park under special conditions. Examples of different purposes for which visitors should be allowed are cultural purposes, recreational purposes and educational purposes.
