Your neighbour offers to sell you his car for RM 10,000. He tells you to ‘think about it and let me know by Monday’. On Sunday, he puts a note under your door to say ‘forget it – I want to keep my car’. In your opinion, is the act of your neighbour is right? Explain by referring to the Contract Act 1950 and the decided case/cases.

As per the Malaysian contract law and Contract Act 1950, to form a legal contract enforeceable by law, there are some conditions that must be fullfiled.

The conditions are
1) Offer
2) Acceptance
3) Lawful consideration
4) Free consent
5) Intention to create legal relationship
6) Capability to enter contract

Since, the neighbour made an offer, it was supposed to be accepted. Acceptance is necessary for a contract to exist. The nieghbour cancelled the offer before it was accepted. Legally, the act of neighbour is right but not ethically
