Why aren’t ALL contracts equally enforceable in business law?
All contracts are not equally enforceable in business law because of the following reasons:
1. They are overlapping in nature, for example partnership in business means unlimited liability however with introduction of LLP the liability is not unlimited of the partners.
2. Priority and relaxation
Many a times the top management is bended towards a certain law which leads to strict enforcement of the same.
3. Overlap of business law with public welfare laws
When the business produces something harmful for the producers the public welfare laws come into picture. They over take the business laws and make the business liabile under criminal offence.
