The three major mandates that are established by FLSA are as follows:

  • A living wage for the workers - The FLSA mandates a minimum wage rate (per-hour basis) for all the non-exempt workers or those employees that are paid on an hourly basis. The minimum is granted by the state or federal government whichever is higher
  • Payment for overtime work - As per this mandate, a worker cannot work for more than 40-hour a week on a regular basis and any hour more than that will be understood as overtime and a time-and-a-half of regular pay rate will be applicable for these overtime hours.
  • Regulating child labor - Child labor was restricted in working in extremely hazardous workplaces below 18 years of age and minimum ages and hours for a child worker are also specified as per this mandate.

The doctrine of quid pro quo means something for something in its literal meaning in Latin. It is one type of workplace harassment that involves a demand that an employee will agree to an unwanted sexual advance in exchange for a job benefit. A quid pro quo involves three conditions - a power or authority, improper use of that authority, and a causal relationship between a sexual consideration and some tangible job-related consideration positive or negative. For example, when a supervisor gives assurance of promotion to one of the subordinates out of many, not based on the job performance, but for sexual favor, it comes under a quid pro quo harassment
