The origin of rulemaking is as old as the civilization in itself. However, these are seen from the American rulemaking and are considered in the historical development of rulemaking. The evolution of rulemaking is best understood in parallel with the historical development of American statute law. The symbiotic relationship between legislation and rulemaking was established in the earliest days of the very first Congress. So simply put, statutes and rules depend on one another are based on the rulemaking which has been as parallel to the US constitution-making.


The laws are transferred into rules based on the social and participative decision of what and how and for whom if applicable. The lawyers are there to interpret the laws into its rules which have to be understood by all participating. The contingency of the rules is applied since the early days of the history of rulemaking. The people have been using it in sports in dispute settlement and various other issues since the early days of civilization. The best aspect of the rulemaking is the participation of the people who are supposed to be under the law or rules. The constitutional is projected as Votes in a democracy and business; the business uses the 2 parties to apply the rule. So yes, the participation matters in such a case as the law or rules of the process have to be followed and this ensures the parties in the process understand it and gives a written not if it’s a transaction like the business.
