Plain view Doctrine is allowing the officer to seizes the property without warrant, contraband , evidence that are found visible during the Legal Observation. he should have the Probable cause shows that the Item is Evidence of Crime or is contraband.
Forth Amendments: it is the exception of the Plain View Doctrine . Untill and unless the Officer signed the search warrant by the Judge , the officer cannot search the things or property.
The contraband which seized under the plain view doctrine may be used to convict for a crime, there is no procecution if the evidence is illigally obtained .There Three condition are need to satisfy for the suspect to a crime are: (a) The object is visible to the Officer or should be Plain view.(b) he should have the legal right or search warrant in order to discover contraband (c) indicative of criminal activity clearly observe by the Officer.
