Tort of Negligence can be defined as a lack of reasonable action by one party against another party. Negligence torts occur unintentionally and out of negligence due to which a party suffers from an injury or financial loss. Like all other kinds of torts, the negligence tort also consists of few elements that are described below:

  • a party is obliged to perform a duty towards the victim
  • the party owing the duty must violate the promise
  • due to that violation an injury or loss must occur
  • the loss or injury caused is a result of the carelesness or negligence of the concerned party

Eg: Car accidents happen due to the negligence of the person driving the car.
