Why was the basis of the parent’s argument that they were not bound by the written contract in the Scalisi et al. v. New York University Medical Center case? I found Scalisi v. New York University Medical Center to be very interesting. Since the wife had a family history of autism, her and her husband deiced to ?have, get, do,?? vitro fertilization. NYU medical center orally assured them that if the wife carrying their child/children would not case the child to be affected by autism. The couple also singed a written agreement that stated that there was a percentage of children that are born with physical and mental defects and that its physicians do not assume responsibility for the defects. (should I just quota the thing?) The court dismissed the oral contract due the written contract. I agree with the ruling, the parents should have read the contract carefully, and honestly they should have questioned the physician and his promises after reading it.
The only oral agreements I have entered into have been with friends or family, its hasn’t always turned out okay, however the agreements were always small things.
