Attorney jones uses her position of trust to convince her client sally to enter into a contract with jones that’s to Sally’s disadvantage. Sally later realizes what has happened and seeks to get out of the contract. What defense should she make against enforcing the contract.
Sally was not forced to enter into contract with Jones. Attorney only used her position and trust to convince Sally into entering such contract. Sally entered into the contract in her full state of sound mind. This can work up against Sally.
However the contact was deceptive . She was not made clearly aware of the liability arising out of the contract . She in the good faith entered into contract. She was played foul by attorney.
